Terms of service
Version 2026-06-18 — effective from launch.
Home IQ is a product of Building IQ Limited and is operated by it. These terms of service ("Terms") are an agreement between you and Building IQ Limited ("Home IQ", "we", "us", or "our") and govern your use of the Home IQ service ("Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. About the Service
Home IQ is a New Zealand subscription software service that helps you keep track of your property, maintenance reminders, documents and related records. The features available to you depend on the plan you are on. We may add, change or remove features over time as the Service develops.
2. Your account
Home IQ uses passwordless sign-in. You access your account using a one-time magic link sent to your email address, or a passkey registered on your device. We never ask for or store a password. You are responsible for keeping access to your email account and your devices secure, because anyone with that access can sign in as you.
You must give accurate account information and keep it up to date. You are responsible for activity that happens under your account. If you think someone has gained access to your account without your permission, contact us promptly at support@homeiq.nz.
3. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in breach of any applicable law
- Attempt to gain unauthorised access to the Service, other accounts, or our systems
- Interfere with, disrupt, or place an unreasonable load on the Service or the servers and networks it relies on
- Reverse engineer, scrape, or copy the Service except to the extent the law does not allow this restriction
- Upload malicious code, or content you do not have the right to share
- Use the Service to send spam or unsolicited commercial messages
4. Your content and ownership
You keep ownership of all content you add to the Service, including your property details, documents and files ("Your Content"). You grant us a licence to store, display, back up and process Your Content only as needed to provide the Service to you and to keep it running and secure.
We own the Service itself, including the software, design and our branding. These Terms do not transfer any of those rights to you. If you send us feedback or suggestions, we may use them to improve the Service without any obligation to you.
5. Privacy
Our handling of your personal information is described in our Privacy Policy, which forms part of these Terms. The Privacy Policy explains what we collect, why, how long we keep it, who we share it with, and the rights you have under the Privacy Act 2020.
6. Subscriptions, billing and GST
Paid plans are billed in advance through our payment provider, Stripe, on a monthly or annual basis depending on the billing cycle you choose. New paid plans start with a 7-day free trial; if you do not cancel before the trial ends, your subscription begins and the first payment is charged.
Prices are shown in New Zealand dollars and include GST — the price you see is the price you pay, with nothing added at checkout. As a GST-registered New Zealand business we account for 15% GST within the advertised price, and the GST component is shown on your invoice. Your subscription renews automatically at the end of each billing period at the then-current price until you cancel. We will give you reasonable notice of any price change before it applies to you.
7. Cancellations and refunds
You can cancel your subscription at any time from your account settings. When you cancel, your plan continues until the end of the billing period you have already paid for, and it will not renew after that. We do not give pro-rata refunds for the unused part of a billing period, except where the Consumer Guarantees Act 1993 or other New Zealand law requires a remedy. Nothing in these Terms limits rights you have that cannot be excluded under New Zealand consumer law.
8. Service availability and support
We aim to keep the Service available and reliable, but we do not guarantee uninterrupted access. We may carry out maintenance that briefly affects availability, and we will try to schedule significant maintenance to minimise disruption. Email support is available at support@homeiq.nz; we aim to respond within 24 hours on New Zealand business days.
9. Disclaimers and limitation of liability
The Service is a tool to help you organise property information and reminders. It is not professional building, legal, financial or safety advice, and you should not rely on it as a substitute for advice from a qualified professional. You are responsible for keeping your own copies of important documents.
To the maximum extent permitted by law, and subject to your rights under the Consumer Guarantees Act 1993, the Service is provided "as is"; we are not liable for any indirect, incidental, special or consequential loss, or loss of data or profits; and our total liability to you for any claim is limited to the fees you paid us in the 12 months before the event giving rise to the claim. Where the Consumer Guarantees Act applies and you acquire the Service for personal use, your rights under that Act are not affected by this clause.
10. Suspension and termination
You may stop using the Service and delete your account at any time from your account settings. When you request deletion, it is scheduled with a 7-day cooling-off period: we email you to confirm, and you can cancel the deletion within those 7 days by signing back in. After that, your personal data is anonymised or deleted as described in our Privacy Policy, except for billing and tax records we are required to keep.
We may suspend or terminate your access if you breach these Terms, if your payment fails and is not resolved, or if we reasonably need to in order to protect the Service or other users. Where it is practical and lawful to do so, we will give you notice and a chance to put things right first.
11. Changes to these Terms
We may update these Terms from time to time. Each version has an effective date shown at the top of this page. If we make a material change, we will give you reasonable notice by email or through the Service before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms. We keep a record of which version you agreed to when you signed up.
12. Governing law
These Terms are governed by the laws of New Zealand, and the New Zealand courts have non-exclusive jurisdiction over any dispute relating to them.
